EVENT TERMS AND CONDITIONS

By submitting my Event Registration, I hereby declare that:
 
1  I, as a Rider, understand that the Event that I am entering [“the Event”] will be run under the Event Terms, Conditions and Rules [“the TCRs”], as defined by the Event Organiser.  I hereby agree to comply with the TCRs and any other rulings stipulated by the Event Organiser, being CHARITY BIKE RIDES (“the Event Organiser”).  I understand that I will not be entitled to a refund of my entry fee [“Entry Fee”] if I am disqualified from the Event as a result of any infringement of these TCRs.

 

2  I agree that it is my responsibility to understand and abide by the TCRs before, during and after the Event; and I agree that the decision of the Event Organiser will be binding and final in all circumstances.

    THE EVENT
3  The Event will be staged on Sunday 22 August 2021 [the Event Date].
I accept that the Event Organiser’s description of the Event [the “Thames Head Challenge”] - as described on this website - is accurate at the time of writing but is subject to possible variation at a later date without notice.  Any references to distances and other measurements are accepted as approximate only.  Where the Event Organiser either needs to, or is bound to, make a variation in the Event, then unless that variation is considered minor, details of that variation will be posted on the Event website:

4  I accept that all correspondence and enquiries about the Event shall be directed to the Event Organiser.  Sponsors, agents and partners of the Event Organiser cannot deal with enquiries relating to Event entries or the Event itself.
 

    REGISTRATIONS
5  I accept that Entry into the Event is dependent upon completion of the two Stage Event Registration process, being:

Stage 1 – Online Event Registration, to reserve a Rider’s place
Stage 2 – Detailed Event Registration, to provide specific Rider details

On completion of Stage 1, Riders will receive by email a link to a further Online form in order to complete their Stage 2 Registration process. 
 

6  I commit to paying for my Event entry via the means offered to me on the Event website:

7  Participating Riders must be at least 14yrs of age at the Event Date.
For Riders considered as minors [those under 18yrs] their Event Registration must be completed by a parent or legal guardian who also gives consent for their participation and accepts these TCRs on their behalf.

Additionally, in the case of Riders between the ages of 14yrs and 15yrs, a statement from their parent or legal guardian will be required as to the Rider’s proficiency and ability to take part in the Event safely.

 

Riders aged under 16yrs may be required to be accompanied by an adult Rider.  This restriction is related to the Event Organisers’ insurance cover.  Cycling on open roads is not without risk and our own Public Liability insurance is effective when ONLY age qualified Riders participate.

8  I understand that confirmed entry to the Event is dependent on 
a.    fully and accurately completed Stage 1 Event Registration 
b.    payment to cover my Entry Fee 

at least 3 working days in advance of the Event and 

c.    fully and accurately completed Stage 2 Event Registration
If any of these conditions are not fulfilled then my Entry may not be valid and therefore not be accepted.  

 

9  I acknowledge that Event entry is personal to me and that I may not exchange it, sell it, or transfer it to any other person - except as permitted under clause 22 regarding Substitute Riders.
 

    PARTICIPATION
10  I agree to conduct myself in a courteous manner during my participation in the Event and understand that I may be disqualified if I do not.  

 

11  I understand and accept that I participate in the Event entirely at my own risk, that I must rely on my own ability in dealing with all hazards, and that I must conduct myself in a manner that is safe for myself and all others throughout the duration of the Event.
 

12  I take full responsibility for my own actions and their consequences whilst participating in the Event.

13  During my participation in the Event I will cycle with care and attention, abiding by the TCRs, the UK Highway Code and any other rulings stipulated by the Event Organiser.  I accept that the function of the Marshals and relevant signage is only to indicate direction and that I must decide if my own on road movements are safe.
 

14  I acknowledge that participation in the Event is likely to be physically strenuous and demanding.  I am aware of the nature of the Event and the potential medical and physical risks involved.  I further certify that I am physically capable of participating in the Event and completing within the time allowed.  
I will only participate in the Event if I am fit enough to do so.

 

15  If I have any medical condition/s, including allergies, which I consider the Event Organiser, or their appointed medical advisors, need to be aware of, I undertake to provide those details within my Event Registration [Stage 2].
 

16  I accept full liability and responsibility for any medical expenses incurred as a result of training for and/or participating in the Event.
 

17  I accept that whilst the Event Organiser takes every care with the staging of the Event, I must make all reasonable precautions for the safeguarding of my person and of my property during my participation in the Event.  I further acknowledge that personal accident and personal items insurance is my own responsibility.
 

18  I accept that it is my responsibility to procure and use a suitable bicycle fit for purpose, cycling helmet and other safe riding equipment of my preference, such as high-vis apparel and daytime-running lights.  The Event Organiser reserves the right to make a ruling as to whether the bicycle and equipment are considered suitable.

    CANCELLATION
19  In all circumstances the Event Organiser will apply all endeavours to make sure the Event goes ahead as planned.  

 

20  I accept that the Event Organiser reserves the right to cancel the Event due to health and safety reasons, such as extreme weather including storms, rains, winds or any other Act of God conditions.  I accept that my Entry Fee shall not be refundable in such circumstances but, instead, shall be carried over and applied to a re-staging of the Event at a later date.
 

21  If the Event is cancelled outright with no prospect of the Event being re-staged within the time window of 3mths and 13mths following the Event Date, then a full refund of Entry Fees will be made.

22  I accept that if I fail to participate for any reason in the Event then my Entry Fee is non-refundable - unless I withdraw to nominate a Substitute Rider and my Event Place is transferred by the Event Organiser to that Rider.  
In such circumstance the following applies:
a.    The Substitute Rider registers for the Event in the usual way

Including completion of Stages 1+2 of the Registration process and payment

b.    The Registration process is completed at least 3days prior to the Event
c.    Following confirmed transfer, a refund will be made to the Rider replaced

The refund will be subject to a £5 admin charge
    

23  I accept that Rider withdrawals and/or refunds, where they may apply, is the sole responsibility of the Event Organiser and not their sponsors, agents or partners.  
The Event Organiser’s sponsor and partner handling Stage 1 Event Registration is limited to that process only.  If for any reason a refund is payable according to the Event TCRs, then the Event Organiser will make that refund.

    PERSONAL DATA
24  I accept that personal data I provide in connection with Event Registration and participation will be processed in accordance with the Event Organiser’s
Privacy Policy.
 

25  I accept that I may feature in visual and/or audio recordings made by the Event Organiser, their sponsors, agents or partners while I am participating in the Event.  I agree that all rights attached to such recordings belong to the Event Organiser. 
 

    RULES and RULINGS
26  The Rules for the Event relate to matters of health and safety and general conduct.  Riders and their Support Teams are expected to abide by them.  Whilst the Rules primarily relate to the health and safety interests of all particpants, they are also intended to help protect the interests of 3rd parties whether or not they are connected with the Event.  

Please review the Rules.
 

27  Rulings will be made by the Event Organiser with respect to particular issues arising either before the Event or on the day of the Event.
 

28  Infringement of the Rules or Rulings may result in disqualification of the participant and, depending on the infrindgment, their Team also.
 

29  I accept that all decisions and rulings by the Event Organiser, howsoever made, will be binding and final in all circumstances.

    VARIANCE 
30  I accept that the Event Organiser reserves the right to amend or alter any aspect of the Event, including the route, in the interests of safety or unexpected circumstances.  Where the Event Organiser either needs to, or is bound to, make such a variation, then unless that variation is considered minor, details of the variation will be posted on the Event website:

31  I accept that the Event Organiser reserves the right to vary these TCRs to be effective immediately upon posting on the Event website.

     Limitation of Liability – your attention is particularly drawn to this section

    LIABILITY
32  Nothing in these TCRs excludes or limits the Event Organiser’s liability for any matter for which it would be illegal for the Event Organiser to exclude or attempt to exclude their liability, including but not limited to death or personal injury caused by their negligence.

 

    FAILURE TO PERFORM
33  The Event Organiser will not be liable or responsible for any failure to perform, or delay in performance, of any of their obligations under the TCRs caused by events outside their reasonable control, otherwise referred to as a Force Majeure Event.

 

    THIRD PARTIES
34  A person who is not party to these Terms and Conditions shall not have any rights under or in connection with them under the Contracts [Rights of Third Parties] Act 1999 or any subsequent amendments thereto.

    AGREEMENT
35  These TCRs [and the documents referred to in them – including details given on the Event website] constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Event.  The participant acknowledges and agrees that in submitting their two- Stage Event Registration they do not rely on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance [whether negligently or innocently made] of any person [whether party to this agreement or not] other than as expressly set out in these TCRs.

 

36  To the extent permitted by law, all provisions of these TCRs shall be severable and no provision shall be affected by the invalidity or unenforceability of any other provision.
 

    DISPUTES
37  These TCRs and any dispute or claim arising out of or in connection with them or their subject matter or formation [including non-contractual disputes or claims] shall be governed by and construed in accordance with the law of England and Wales.  The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction.
